Access to simpler property settlements now available nationally — a Women’s Legal initiative

Women and non-binary people across Australia separating from a partner now have access to a simpler, safer way to resolve property disputes through a nationally expanded program developed by Women’s Legal Service Victoria.

The Priority Property Pool program is now available nationally, expanding access to a streamlined court process designed for people who may not be able to afford a private lawyer.

What is the Priority Property Pool?

The Priority Property Pool a offers a simpler way for separating couples to sort out property matters worth up to $550,000 (not including super).

It is designed to:

  • reduce delay and complexity in property matters
  • support fairer financial outcomes
  • help people move forward sooner after separation

The program has been operating in Melbourne, Adelaide, Brisbane and Parramatta since 2020, and its national rollout marks a significant step forward in improving access to justice.

Better outcomes for women after separation

An evaluation of the program found that participants experienced improved financial wellbeing, including an increased ability to build financial independence and establish safety after leaving a relationship.

This reform reflects what many clients tell us: costly, lengthy court processes often force women to walk away from property settlements, particularly where family violence or financial abuse is involved.

For many, the barriers are not about entitlement — they are about affordability, safety and the emotional toll of drawn‑out legal proceedings.

Designed with safety in mind

Women’s Legal worked closely with the Court to ensure the Priority Property Pool cannot be misused by perpetrators of family violence.

Safeguards have been built in so the process cannot be used by people using violence to:

  • continue coercive control
  • financially damage a victim‑survivor

This focus on safety is critical to ensuring the program genuinely supports women who are seeking to move on from unsafe relationships.

Advocacy that delivers real change

We are proud to see our advocacy contribute to reforms that improve outcomes for women — particularly victim‑survivors of family violence, who are disproportionately impacted by financial abuse and unfair property outcomes.

Women's Legal CEO Claudia Fatone told ABC News that this is an important step toward a legal system that puts victim-survivors' safety front and centre, so they can stay safe and seek justice. 

Access to a fair share of property after separation is not just about finances. It is about safety, stability and the ability to rebuild a life free from violence.
